Equality Lost: Essays in Torah Commentary, Halacha, and Jewish Thought , Rabbi Yehuda Herzl Henkin
Description: At last, a posek (a recognized expert in Jewish law) and author of three volumes of Responsa, has written a book illustrating the depth and sensitivity of Jewish law and thought in addressing crucial issues of our time. Rabbi Yehuda Henkin fearlessly confronts modern as well as timeless questions. His original interpretations and views are solidly based upon traditional sources and the oral transmission of the enlightened spirit of Judaism. In Equality Lost, Rabbi Henkin teaches how to extract the straight-forward explanation (peshat) in the Torah and demonstrates how to interpret Halacha in regard to women in the age of feminism, the conversion to Judaism of children in non-observant homes, and the killing of captured terrorists. Readers will immediate recognize the direct, sensible, and authentically Jewish evaluations of current phenomena such as the glatt kosher craze. In addition, the author provides fresh and unsettling insights into the reasons for the destruction of the Second Temple, the lessons to be learned therefrom, and the ramifications of these lessons for the modern State of Israel.

Jewish Law and the New Reproductive Technologies , Emanuel Feldman
Description: It is man, woman, and God who join together to create a new human child, says the Talmud. Now, with the advent of the New Reproductive Technologies, the doctor-scientist has joined the team, so to speak. Suddenly, humans are not only controlling nature, but creating it as well. All this presents challenges on religious as well as practical levels. Halakha - Jewish Law and Ethics - has much to say about this. For the past quarter century, discussions on the topic have appeared in Tradition, the Journal of Jewish Thought published by the Rabbinical Council of America. Collected here, they offer the general reader an insight into how classic Jewish Law continues to offer insights into the most contemporary of problems.

Playing Ball On Shabbat And Yom Tov , Rabbi Saul J. Berman
Description: A review of the halakhic opinions from talmudic to contemporary authorities regarding the permissibility of playing ball on shabbat and yom tov. The author concludes that while contemporary custom is to refrain from playing ball on those days, normative legal opinion holds that such activity is permitted. He advances the idea that creative ways need to be found to utilize time more spiritually on shabbat and yom tov, perhaps through the permitted activity of ball playing.

Piety and Fanaticism: Rabbinic Criticism of Religious Stringency , Sara Weinstein
Description: Within traditional Judaism, religious piety and intensity, representing the earnest and passionate desire to serve God, is often expressed in both the strictest observance of halakhah, Jewish law, and in practices above and beyond the demands of the law. The second such behavior is termed "super-erogatory," meaning "going beyond what is commanded or required." While it is discussed often in the Talmud, there is little attention given in the secondary literature to the rabbis' critique of self-imposed religious stringency. Piety and Fanaticism Rabbinic Criticism of Religious Stringency opens a discussion of the Talmudic rabbis' views. Piety and Fanaticism focuses its discussion on self-imposed stringency, which goes beyond the recommendations of a specific halakhic ruling, and evaluates the rabbis' decisions as to when super-erogation by an individual was generally permitted and when it was criticized. Also addressed is to what extent the rabbis' considered kavvana, or why an individual chose to take on a specific stringency, in their criticism of such behavior. Weinstein considers the political and economic differences in Palestine and Babylon to explain differences in the rabbinic opinions of the Palestinian and Babylonian Talmuds. The historical development of Talmudic passages has been analyzed to discover the various layers of text and place them in proper historical context. The author also examines the relationship between Judaism and other religions of the Talmudic periodspecifically early Christianity, which venerated practices that were regarded as super-erogatory by Judaism.

Rabbinic Authority and Personal Autonomy , Moshe Sokol
Description: Does traditional Jewish life encourage or discourage personal autonomy? To what extent are decisions of Jewish law influenced by subjective factors? Does rabbinic authority extend to all areas of life or does it confine itself to a narrower field of influence? What freedom does a rabbinic authority have to make innovations, and are there grounds for pluralism within the system of Jewish law? These questions cut to the core of Jewish life in the modern world. With the advent of modernity, great emphasis has been placed on the value of personal autonomy. Yet traditional Judaism has historically emphasized the authority of the rabbinic decision maker. The essays in this volume are concerned with exploring the tension between these two poles. Experts from such diverse fields as history, sociology, philosophy, and Jewish law explore the questions raised above. Their analyses are informed not only by their academic expertise but by their deep understanding of the Jewish legal system and Jewish life and their abiding concern for what it means to live that life in the modern world. The contributors to this volume were participants in the Orthodox Forum, an annual gathering of scholars who meet to consider major issues of concern to the Jewish community.

Rabbi Jehiel Jacob Weinberg on the Limits of Halakhic Development , Dr. Marc B. Shapiro
Description: What are the limits of halakhic development? This is the issue that Rabbi. Weinberg tackles in a fascinating letter published here for the first time. He also discusses his controversial student, Rabbi Eliezer Berkovits. Although Berkovits always believed that he was following in the path of his teacher, we see that R. Weinberg was distressed by some of his student's more extreme positions. Yet despite this, Rabbi Weinberg remained loyal to Berkovits and defended his student against those who vilified him and wished to exclude him from Orthodoxy.
